CANAL INTERNO DE INFORMACIÓN

SISTEMA INTERNO DE INFORMACIÓN

Con el fin de cumplir con las obligaciones legales dispuestas en la Ley 2/2023, de 20 de febrero, reguladora de la protección de las personas que informen sobre infracciones normativas y de lucha contra la corrupción, GRUPO INALSA ha implantado un sistema interno de información para que, tanto las personas que forman parte de la organización como aquellas que hayan tenido o vayan a tener una relación profesional con la empresa, cuenten con cauces estandarizados para presentar informaciones que permitan detectar y/o prevenir irregularidades.

CANAL INTERNO DE INFORMACIÓN

GRUPO INALSA pone a disposición de cualquier persona que quiera enviar una información sobre acciones u omisiones constitutivas de cualquiera de las infracciones señaladas en la normativa anteriormente mencionada, un canal interno de información accesible 24 horas y desde cualquier dispositivo con conexión a internet.

INFORMACIONES ANÓNIMAS Y DATOS PERSONALES

Las informaciones podrán ser tanto nominativas, es decir, con identificación de la persona informante, como anónimas. Se garantizará máxima confidencialidad y sólo las personas designadas podrán acceder al expediente.

USO DEL CANAL INTERNO DE INFORMACIÓN

Este canal interno de información en ningún caso será un buzón sugerencias, quejas y reclamaciones, solo se tramitarán informaciones recibidas que estén recogidas en el artículo 2 de la ley anteriormente mencionada. En ningún caso se atenderán:

a) Informaciones contenidas en comunicaciones que hayan sido inadmitidas por algún canal interno de información o por alguna de las causas previstas en el artículo 18.2.a), de la Ley 2/2023, de 20 de febrero.

b) Informaciones vinculadas a reclamaciones sobre conflictos interpersonales o que afecten únicamente a la persona informante y a las personas a las que se refiera la comunicación o revelación.

c) Informaciones que ya estén completamente disponibles para el público o que constituyan meros rumores.

d) Informaciones que se refieran a acciones u omisiones no comprendidas en el artículo 2 de la Ley 2/2023, de 20 de febrero.

CONFIDENCIALIDAD Y PROHIBICIÓN DE REPRESALIAS

GRUPO INALSA asume el compromiso de guardar absoluta confidencialidad de toda la información recibida y gestionada a través del canal interno de información. Por este motivo, GRUPO INALSA investigará y, en su caso, sancionará cualquier infracción del deber de confidencialidad y secreto al que todas las personas involucradas en la gestión de las informaciones están obligadas. Del mismo modo, se garantiza que no se tomarán, en ningún caso, represalias en contra de la persona que haya presentado una comunicación de buena fe a través del sistema interno de información.

En los casos en que se constate que la información o conducta reportada resulta ser infundada, y realizada de mala fe (es decir, con conocimiento de su falsedad o manifiesto desprecio a la verdad o con el único objetivo de causar un perjuicio a la persona afectada), se adoptarán frente a dicho/a informante, las medidas disciplinarias que correspondan.

INFRACCIONES Y SANCIONES

En caso de determinarse que las acusaciones descritas en la información son falsas o maliciosas, en la medida en que hayan sido realizadas de manera deliberada con conocimiento de su falsedad o temerario desprecio a la verdad, estas podrán ser consideradas como una infracción muy grave, lo que conllevará la imposición de sanciones disciplinarias, penales y económicas, pudiendo llegar hasta los 300.000€.

PROTECCIÓN DE DATOS

La persona responsable del tratamiento de los datos de carácter personal que se recaben en el marco del sistema interno de información es el órgano de administración de GRUPO INALSA.

Los datos personales recabados en el marco del sistema interno de información serán los estricta y objetivamente necesarios para tramitar las informaciones recibidas y, en su caso, investigar los hechos comunicados. Dichos datos serán tratados con esa exclusiva finalidad y no serán utilizados para finalidades incompatibles. El tratamiento de datos personales a través de este canal interno de información está legitimado por tratarse de una obligación legal.

Los datos personales recabados no serán cedidos a terceros, salvo a petición razonada de la Autoridad judicial competente, mediante auto, y en el marco de un procedimiento judicial y bajo la tutela de aquella. En cualquier caso, si los hechos comunicados revistieran carácter delictivo sí que se comunicarán al Ministerio Fiscal.

Será lícito el tratamiento de los datos por otras personas, o incluso su comunicación a terceros, cuando resulte necesario para la adopción de medidas correctoras en la entidad o la tramitación de los procedimientos sancionadores o penales que, en su caso, procedan.

INALSA GROUP met à la disposition de toute personne souhaitant envoyer des informations sur des actions ou omissions constituant l’une des infractions indiquées dans la réglementation susmentionnée, un canal d’information interne accessible 24 heures sur 24 et depuis tout appareil disposant d’une connexion Internet.

INFORMATIONS ANONYMES ET DONNÉES PERSONNELLES

Les informations peuvent être à la fois nominatives, c’est-à-dire avec identification du déclarant, ou anonymes. Une confidentialité maximale sera garantie et seules les personnes désignées pourront accéder au dossier.

UTILISATION DU CANAL D’INFORMATION INTERNE

Ce canal d’information interne ne sera en aucun cas une boîte aux lettres de suggestions, réclamations et réclamations, seules les informations reçues qui sont incluses dans l’article 2 de la loi précitée seront traitées. En aucun cas ne seront pris en compte :

CONFIDENTIALITÉ ET INTERDICTION DES REPRÉSAILLES

INALSA GROUP s’engage à maintenir la confidentialité absolue de toutes les informations reçues et gérées via le canal d’information interne. C’est pour cette raison que GRUPO INALSA enquêtera et, le cas échéant, sanctionnera toute violation du devoir de confidentialité et de secret auquel sont tenues toutes les personnes impliquées dans la gestion de l’information. De même, il est garanti qu’en aucun cas des représailles ne seront exercées contre la personne qui aura soumis une communication de bonne foi via le système d’information interne.

Dans les cas où il s’avère que l’information ou le comportement signalé s’avère infondé et réalisé de mauvaise foi (c’est-à-dire en connaissance de sa fausseté ou en un mépris manifeste de la vérité ou dans le seul objectif de causer un préjudice à la personne concernée) personne), les mesures disciplinaires correspondantes seront adoptées à l’encontre dudit informateur.

Dieser interne Informationskanal ist in keinem Fall ein Postfach für Vorschläge, Beschwerden und Ansprüche. Es werden nur die erhaltenen Informationen verarbeitet, die in Artikel 2 des oben genannten Gesetzes enthalten sind. In keinem Fall wird Folgendes berücksichtigt:

a) Informationen in Mitteilungen, die über einen internen Informationskanal oder aus einem der in Artikel 18.2.a) des Gesetzes 2/2023 vom 20. Februar genannten Gründe unzulässig waren.

VERTRAULICHKEIT UND VERBOT VON VERGELTUNGSMASSNAHMEN

Die INALSA GROUP verpflichtet sich zur absoluten Vertraulichkeit aller über den internen Informationskanal erhaltenen und verwalteten Informationen. Aus diesem Grund wird GRUPO INALSA jeden Verstoß gegen die Vertraulichkeits- und Geheimhaltungspflicht, zu der alle an der Verwaltung von Informationen beteiligten Personen verpflichtet sind, untersuchen und gegebenenfalls sanktionieren.
